By accessing and using PodFM ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the App.

2. Description of Service

PodFM provides AI-generated podcast content. The content is generated in real-time using artificial intelligence technology to create personalized audio experiences.

3. User Accounts

To use certain features of the App, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not use the App while operating a vehicle or in any situation where your attention is required for safety
• Not attempt to reverse engineer, decompile, or disassemble any part of the App
• Not use the App in any way that could damage, disable, or impair the service

5. Content and Intellectual Property

All content generated by the App, including but not limited to audio, text, and graphics, is owned by PodFM or its licensors. The AI-generated content is provided for personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from the content without express written permission.

6. AI-Generated Content Disclaimer

The content provided by PodFM is generated by artificial intelligence and may contain inaccuracies or errors. While we strive to provide accurate and informative content, we make no warranties or representations about the accuracy, completeness, or reliability of the information provided.

7. Limitation of Liability

To the maximum extent permitted by law, PodFM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or the like that may be transmitted through the App

8. Subscription and Payment

Certain features of the App may require a paid subscription. Payment will be charged to your iTunes Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

9. Termination

We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which PodFM operates, without regard to its conflict of law provisions.
